On October 4 the House Education and the Workforce Committee approved H.R. 3441, The Save Local Business Act, by a vote of 23 to 17. 

ICSC submitted a letter to the committee in support of this legislation which would restore the previous and narrower definition of a “joint employer.”  The next step for H.R. 3441 will be consideration by the full U.S. House of Representatives.

In August 2015, the National Labor Relations Board expanded the definition of a “joint employer,” causing ICSC members concern about existing contractual relationships between shopping center owners, service providers and tenants.

The broadening of what constitutes a “joint employer” means shopping center owners, service providers and tenants throughout the country who rely on contractors and subcontractors may be held liable for the actions of those with whom they contract or the venues in which they operate.
